The statute is unusual, also, because it places a high burden on EPA to demonstrate that there’s a significant danger before it can demand from the industry of UPVC Windows and UPVC doors that they produce the evidence.
Now, just like pharmaceuticals, and like pesticides, and other products that we’ve talked about, how much sense does it make to have the industry producing the data themselves, and then presenting their case to the Environmental Protection Agency for licensing? Where should this occur? Should there be some sort of an independent organization set up that would be more protected from potential bias? Clearly there is an economic stake involved, and industry is anxious to spend that money for UPVC Doors.
This high burden on EPA to demonstrate danger is the primary reason for the failure of the Toxic Substance Control Act.
